Welcome to Himekoi. We deeply respect the intellectual property rights of others and expect the same from others regarding our rights. Under the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their agents can submit takedown notices to us through our DMCA Agent listed below. As an internet service provider, we can claim immunity from these infringement claims under the DMCA's "safe harbor" provisions. To submit a good faith infringement claim to us, please include the following information in your notice:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the infringing material to be removed, with information sufficient to allow us to locate the material. Please provide the URL of the page in question to help us identify the allegedly offending work.
  4. Information sufficient to allow us to contact the complaining party, including your name, physical address, email address, phone number, and fax number.
  5. A statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Under Title 17 USC §512(f), anyone who knowingly and materially misrepresents information in a notification of infringement may be subject to civil penalties, including costs and attorney fees.

Please be aware that we may share the identity and information in any copyright infringement claim we receive with the alleged infringer. By submitting a claim, you agree that your identity and claim details may be communicated to the alleged infringer.

Counter Notification – Restoration of Material

If your material has been removed due to a copyright infringement claim, you may send us a counter notification to have the material restored. The counter notification must be submitted in writing to our DMCA Agent and should include the following elements as required by 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material that was removed and its original location before removal.
  3. A statement under penalty of perjury that you believe in good faith that the material was removed or disabled due to a mistake or misidentification.
  4. Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court for your address (or any judicial district if you are outside the United States), and that you will accept service of process from the person who provided the original infringement notification.

Repeat Infringer Policy

We take copyright infringement very seriously. In accordance with the repeat infringer policy requirements of the DMCA, we maintain records of DMCA notices from copyright holders and make a good faith effort to identify repeat infringers. Accounts of those who violate our repeat infringer policy will be terminated.

Intellectual Property and Publicity Rights

Himekoi is proud of our engagement with fans and communities. We collaborate with freelance designers globally and rigorously audit design submissions before listing them on our store. However, instances of misrepresented art may still occur. If any artwork on our website is yours and you can prove it, we will remove it within 24 hours and give you due credit.

COPYRIGHT law protects original expressions recorded in a tangible form, such as photographs, paintings, poems, and stories.

TRADEMARK law protects words, symbols, designs, or logos that identify and distinguish the source of goods.

PUBLICITY RIGHTS protect an individual’s name, image, and likeness, preventing their use for commercial gain without consent.

If you believe your content has been used in a way that infringes your rights, please notify Himekoi by sending a Notice and Takedown Report to the designated email: support@himekoi.com. The report must include:

  1. A link to the item that infringes on your rights.
  2. Proof of your artwork (e.g., a webpage or other evidence).
  3. Your name and contact information.
  4. Title the email: TAKEDOWN REPORT.
